Filing 27 OPINION & ORDER re: 18 MOTION to Dismiss pursuant to Rule 12C and motion for sanctions filed by NYPD, Vanity Medina, City of New York. For the foregoing reasons, Plaintiff's claims against the City of New York for fai ling to discipline or sanction police officers and failing to intervene to prevent violations of his constitutional rights and all claims against the New York City Police Department are DISMISSED. Defendants' motion with respect to the remai ning claims is DENIED. Because Plaintiff's claims for false arrest and malicious prosecution are not completely without merit, Defendants' motion for Rule 11 sanctions is DENIED.
