July 15, 2014 Opinion or Order Filing 79 OPINION AND ORDER re: 54 MOTION to Dismiss-Consolidated Motion to Dismiss and Motion for Partial Summary Judgment filed by Brown Rudnick, LLP, Emilio A. Galvan. For the reasons stated above, Counter-Defendants' motion to dismi ss is GRANTED in part and DENIED in part. In addition, although SOI has not moved for summary judgment, the Court nevertheless dismisses Count 3 of Brown Rudnick's Complaint, as Brown Rudnick has had an adequate opportunity to come forward w ith all of its evidence, see Orix Credit Alliance, 965 F. Supp. at 484, and the undisputed evidence reveals that Defendant is entitled to judgment as a matter of law. The Clerk of the Court is directed to terminate Docket No. 54.
