March 27, 2015 Opinion or Order Filing 35 OPINION AND ORDER: For the foregoing reasons, the Court DENIES Defendants motion to dismiss as it applies to Plaintiff's copyright infringement claim, but GRANTS the motion as it applies to the unjust enrichment claim. In order to proceed with the copyright claim, however, Plaintiff must submit an amended Exhibit 1 to the First Amended Complaint by April 8, 2015. The current version of that exhibit appears to contain several incomplete publication titles. (See, e.g., FAC Ex. 1 at 1 (listing publication titles "Understanding Human" and "Core Concepts in")). January 31, 2014 Opinion or Order Filing 18 OPINION & ORDER re: 7 MOTION to Dismiss filed by The McGraw Hill Companies: For the foregoing reasons, the Court GRANTS Defendant's motion to dismiss under Rule 12(b)(6) as to both Counts I and II. Because the Court dismisses both claims under Rule 12(b)(6), it need not address Defendant's motion to dismiss pursuant to Rule 12(b)(7). The Court grants Plaintiff thirty (30) days to replead Count I and Count II's claim for a declaratory judgment premised on a contractual right to an audit. (Signed by Judge Kimba M.
