January 28, 2014 Filing 38 FIRST LETTER addressed to Judge Richard J. Sullivan from Patrick J. Boyd dated 1/28/2014 re: Discovery. Document filed by NGA Tran-Pedretti.(Boyd, Patrick)
January 24, 2014 Opinion or Order Filing 37 ORDER: The Court is in receipt of a joint letter from the parties in which Plaintiff seeks an adjournment of the discovery deadline. (Doc. No. 36.) For the reasons set forth below, the request is denied. On July 26, 2013, the Court held an initial conference on this matter. At that conference, the Court approved a Case Management Plan and Scheduling Order and urged the parties to meet the deadlines in that Order. The Court specifically warned the parties that they should not count on any extensions. On November 25, 2013, four days before the close of fact discovery, the parties wrote to the Court to request a 90-day extension. (Doc. No. 24.) The Court denied this request because the parties had not offered any justification for an extension. (Doc. No. 25.) Plaintiff then submitted a second request, admitting that neither party had taken any depositions even though the close of discovery was now two days away and apologizing for the late request. (Doc. No. 26.) In response, the Court stated that Plaintiff had still not justified the discovery delay or the need for an adjournment and that the Court would therefore "be entirely justified in denying the request." (Doc. No. 27.) Nevertheless, the Court granted a brief extension to January 6, 2014 "in the spirit of the season." (Id.) The Court's flexibility was not unlimited, however. The Court stated very clearly that "[n]o further extensions [would] be permitted." (Id.) The next week, the parties submitted a discovery dispute letter. (Doc. No. 28.) According to that letter, the parties had been unwilling or unable to set a deposition schedule of their own. As a result, the Court was forced to set a schedule for them. (Doc. No. 29.) The Court extended the deposition deadline to January 27, 2014 and, once again, stated that "[n]o further extensions would be permitted." (Id.) Plaintiff now seeks a further extension. Despite the Court's admonition that the parties "get this done" (Id.), some depositions remain undone. At this point, however, Plaintiff's time has run out. No further extension will be permitted. Accordingly, IT IS HEREBY ORDERED THAT Plaintiffs request is DENIED. (Signed by Judge Richard J. Sullivan on 1/24/2014) (mro)
