ORDER ON REPORT AND RECOMMENDATION for 41 Report and Recommendations, 28 Motion to Dismiss filed by Mary J. D'Silva, Allan Jacobson, Carl J. Koenigsmann, Brian Fischer, R. Willim. Correction Law § 24 precludes Plaintiff's s tate law claims from proceeding before this Court. Accordingly, Defendants' motion to dismiss the state law claims is granted. With respect to the remainder of Plaintiff's claims, the Court adopts Magistrate Judge Fox's R&R. The Cou rt denies Defendants' motion to dismiss Plaintiff's claims under 42 U.S.C. § 1983. The Clerk of Court is directed to terminate the motion at Docket Number 28. The reference to Magistrate Judge Fox for further proceedings consistent with this order is continued.
