March 23, 2015 Opinion or Order Filing 47 MEMORANDUM OPINION AND ORDER re: 44 MOTION for Summary Judgment filed by Premiere Acquisition Corp.: Although unopposed, the motion is DENIED for the reasons stated below. Pursuant to the Court's Individual Rules and P ractices in Civil Pro Se Cases, a copy of which is attached, Chang must, within forty-five days of the entry of this Memorandum Opinion and Order, submit a sworn Pretrial Statement with certain information outlined in Paragraph 6(A) of the Individ ual Rules. In accordance with Paragraph 6(A) and (B) of the Court's Individual Rules, within two weeks of the deadline for Chang to file her Statement, Premiere shall file and serve a similar Statement of its case containing the same informat ion, along with proposed voir dire questions, a proposed jury charge, and a proposed verdict form. Chang is cautioned that failure to submit pretrial materials may result in sanctions, up to and including entry of default judgment. See, e.g., Cott on v. Slone, 4 F.3d 176, 179, 181 (2d Cir. 1993) (upholding a district court's entry of a default judgment against a pro se defendant for, among other things, failing to comply with the court's order regarding preparation of a pretrial memorandum); Fed. Nat. Mortg. Ass'n v. Olympia Mortg. Corp., No. 04-CV-4971 (NG)(MDG), 2014 WL 2594340, at *2 (E.D.N.Y. June 10, 2014) (describing situations in which courts have entered default judgments based on a party's failure to defend).
