MEMORANDUM AND ORDER granting 12 Motion to Dismiss; denying 16 Motion for Preliminary Injunction. The Court is confident that a panel of arbitrators will be fully competent to apply established principles of claim preclusion to determine, as a th reshold matter, whether the second arbitration is foreclosed by the judgment in the First Action. Defendant's motion to dismiss and compel arbitration is GRANTED. (Docket #12.) Plaintiff's motion for preliminary injunction is DENIED. (Docket # 16).)
