Filing 71 OPINION AND ORDER re: 55 MOTION to Dismiss for Lack of Jurisdiction MOTION TO DISMISS FOR LACK OF PERSONAL JURISDICTION, LACK OF SUBJECT MATTER JURISDICTION, AND FOR FAILURE TO STATE A CLAIM filed by defendants. For the reasons set f orth within, the Court concludes that it lacks subject-matter jurisdiction over this case. Accordingly, Defendants' motion to dismiss is GRANTED (without prejudice to Plaintiffs' refiling their suit in an appropriate state court), and the Court need not reach Defendants' alternative arguments for dismissal. The Clerk of Court is directed to terminate Docket No. 55 and to close the case. (Signed by Judge Jesse M. Furman on 9/30/2014) (ab) |
