The dismissal is without prejudice to the extent that it is based on deficiencies in the pleadings. If Plaintiff wishes to file a Second Amended Complaint, it shall do so by October 3, 2014. If Plaintiff declines to further amend the pleadings, the Court will schedule an initial case management and scheduling conference, as Defendant has already answered the Amended Complaint.
