Filing 21 MEMORANDUM AND ORDER granting in part and denying in part 13 Motion to Dismiss. For the reasons outlined herein, defendant's motion to dismiss is GRANTED in part and DENIED in part. Defendant's motion to dismiss plaintiff's disabili ty discrimination claims under the ADA, the NYSHRL, and the NYCHRL is denied; defendant's motion to dismiss plaintiff's racial discrimination and retaliation claims is granted. Counsel for defendant shall provide plaintiff with copies o f all unreported decisions cited herein. The Court certifies pursuant to 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith and in forma pauperis status is denied. See Coppedge v.
