OPINION AND ORDER re: 119 FIRST MOTION for Attorney Fees filed by Kwame Garnett, 106 MOTION for Judgment as a Matter of Law filed by Undercover Officer C0039, 109 MOTION for Bill of Costs filed by Kw ame Garnett, 103 MOTION for New Trial filed by Kwame Garnett. For the foregoing reasons, the motions of each of the plaintiff and the defendant, pending at Docket Nos. 103 and 106, respectively, are denied. In addition, the pla intiff's motions for a bill of costs, Docket No. 109, and for attorney's fees and costs, Docket No. 119, are denied without prejudice to renewal. Those motions were made prematurely during the pendency of the motions for judgment as a matter of law and a new trial. They may be renewed following entry of this order. OPINION AND ORDER re: 38 MOTION for Summary Judgment. filed by The City of New York, Neftali Betances, Tyrone Viruet, Undercover Officer C0243, Undercover Officer C0039. As set forth within, the Court denies defendants' summary ju dgment motion on Garnett's false arrest, malicious prosecution, and denial of his right to a fair trial claims against UC 0039 and his failure to intervene claim against UC 0243, and grants summary judgment in favor of UC 0243 on Garnett's false arrest, malicious prosecution, and denial of a right to a fair trial claims.
