July 10, 2014 Opinion or Order Filing 31 OPINION AND ORDER re: 8 FIRST MOTION to Remand to State Court filed by Alba Beltre Morillo, 15 MOTION for Judgment on the Pleadings filed by Hazel Hazzard, New York Hotel & Motel Trades Council, AFL-CIO: The Court has considered all of the arguments raised by the parties. To the extent not specifically addressed, the arguments are either moot or without merit. For the reasons explained above, the plaintiff's motion to remand is denied and the Union Defendants' motion for judgment on the pleadings is granted. The Clerk is directed to close all pending motions. The plaintiffs, Grand Hyatt, and Mason agree that the case should be remanded to the state court if the Union Defendants are dismissed from th e case. Because the Union Defendants are dismissed from the case, the remaining claims are remanded to the New York State Supreme Court, New York County. The Clerk is directed to remand the case. (Signed by Judge John G. Koeltl on 7/10/2014) (tn)
