OPINION & ORDER re: 24 MOTION to Dismiss the Second Amended Complaint filed by Chair for NYCRx, Inc., Lynn Silver, Thomas Farley, City of New York: For the forgoing reasons, Defendants' Motion to Dismiss is GRANTED and t he Plaintiff's Second Amended Complaint is DISMISSED. Plaintiff is not being granted leave to amend the Complaint because he has already amended his Complaint twice and, given the ruling of the Court, further amendment would be futile.
