For the reasons set forth herein: Defendants' motion for summary judgme nt is GRANTED with respect to Garcia's FLSA claim without prejudice to replead with an appropriate plaintiff within thirty (30) days of the date of this Order. Defendants' motion for summary judgment is DENIED without prejudice as against Walden. Defendants' request for attorney's fees and costs is DENIED at this time.
