OPINION AND ORDER re: 41 MOTION for Summary Judgment . filed by Moore Capital Management, LP, 36 MOTION for Summary Judgment . filed by James W. Giddens. For the foregoing reasons, the Trustee's motion is GRANTED to the extent of confirming its determination that MGI's claim is not entitled to customer status, and MGI's motion is DENIED. Further proceedings are necessary to determine whether the Net Cash Balances are property of the estate.
