June 16, 2015 Opinion or Order Filing 34 OPINION AND ORDER: Defendants' motion to dismiss is DENIED. Defendants shall file their answer on or before July 10, 2015. The parties are directed to proceed with discovery on the sole issues of (1) when Okor's Section 1981 claim accr ued and (2) the changes in responsibility and status when a business professor at BMCC is promoted from an adjunct position to a full-time position. This period of discovery shall begin immediately and shall close on August 31, 2015. Defendants may, on or before September 18, 2015, file a motion for summary judgment on the statute of limitations issue. Should Defendants choose not to file a motion for summary judgment at that time, the parties shall proceed with the balance of discovery , which shall close on November 30, 2015. Okor may file a motion to substitute CUNY in place of BMCC as the institutional defendant in this action, provided that he does so within 30 days. The Clerk of Court is directed to close the motion at doc ket number 27. (As further set forth in this Order) Borough of Manhattan Community College answer due 7/10/2015; Chiam Ginsberg answer due 7/10/2015. (Discovery due by 11/30/2015., Motions due by 9/18/2015.)
