October 6, 2016 Opinion or Order Filing 44 OPINION & ORDER: For the foregoing reasons, Tube City's Turnover Motion and Confirmation Motions are granted. Turnover, however, is stayed pending the Court's resolution of issues relating, inter alia, to the calculation of the sum to be turned over, which the parties will brief on a schedule to be set in a separate order. Subject to that limitation, as to the Turnover Motion, the Court finds that the following sums (totaling $279,562.72) were fraudulently conveye d from Anza LLC to the following Transferees, so as support turnover of these funds: (1) Joseph Anza, in the amount of $145,215.22; (2) Alexandra Anza, in the amount of $2,000; (3) JVA Partners, in the amount of $66,847.50; and (4) Omni Steel Supply LLC, in the amount of $65,500. November 14, 2014 Opinion or Order Filing 11 OPINION & ORDER re: 8 MOTION to Serve subpoenas on nonparty by alternative means. MOTION to Compel Anza Capital Partners LLC to respond to document requests and appear for deposition through a designated agent filed by T ube City IMS, LLC. For the reasons explained below, the Court (1) grants Tube City leave to serve subpoenas ad testificandum and duces tecum on non-party Joseph Anza, by substitute service specified herein; (2) compels respondent Anza Capital Partner s, LLC ("Anza Capital") to respond to Tube City's document requests within 30 days, and to appear for a deposition through a designated agent within 60 days; and (3) directs Anza Capital to respond, by December 5, 2014, to Tube City's motion for reasonable expenses incurred in bringing this motion. June 11, 2014 Opinion or Order Filing 6 OPINION & ORDER: The Court has reviewed, in detail, the parties' Agreement, including the arbitration clause, and the Award. On that record, and based on the very limited review that is appropriate on a petition to confirm an arbitral award, the Court concludes that there is no basis to vacate or modify. Accordingly, the Court confirms the Award, and enters judgment in the amount of $227,725.94 to be paid to Tube City.
