Filing 50 OPINION AND ORDER: For the reasons set forth above, Plaintiffs have established that defendants have violated the FLSA and NYLL. Defendants' violations of the same were not in good faith, thereby entitling Plaintiffs to liquidated damages, but they were not willful, thereby confining the statute of limitations to two years. The parties are directed to submit their damage calculations on consent based on this Opinion's conclusions of law by Friday, October 20, 2017. Plaintiffs' counsel will then be given an opportunity to submit an application for attorneys' fees and costs, and as further set forth in this order. (Signed by Judge Edgardo Ramos on 9/29/2017) (ap) |
