Filing 15 OPINION & ORDER: For the foregoing reasons, the Court concludes that the reinstated removal order issued against Guerra is not administratively final and that, therefore, Guerra's detention is governed by § 1226(a), not § 1231. The petition for a writ of habeas corpus is GRANTED. Respondents shall provide Petitioner Deyli Noe Guerra with an individualized bond hearing before an immigration judge by January 2, 2015. The parties shall submit a report to this Court on the outcome of that hearing within five days of a decision by the immigration judge. The Clerk of Court is directed to close this case.
