OPINION AND ORDER: re: 94 MOTION for Recusal. filed by Claude Galland, 90 AMENDED MOTION to Dismiss . filed by James Johnston, Judith Johnston. For the foregoing reasons, Defendants' motion to dismiss is DENIED, and Plaint iffs' motion to recuse Porter and their requests to proceed to trial are DENIED. Claude Galland shall file a letter updating the Court on his medical condition, with supporting medical documentation on or before September 29, 2017. This Opinion and Order resolves Doc. OPINION AND ORDER ADOPTING REPORT AND RECOMMENDATION: re: 30 Report and Recommendation, 10 MOTION to Amend/Correct filed by Claude Galland, Violaine Galland, 22 FIRST MOTION to Dismiss filed by Terri Bowden, Stephen Bowden, [1 8] MOTION to Amend/Correct 2 Complaint filed by Claude Galland, Violaine Galland, 4 MOTION to Dismiss filed by James Johnston, Judith Johnston. For the foregoing reasons, the Court adopts the Report in its entirety and HEREBY ORDERS T HAT the Johnstons' and Bowdens' motion to dismiss are GRANTED to the extent they seek dismissal of all but the breach of contract claims and DENIED to the extent they seek dismissal of the breach of contract claims. IT IS FURTHER ORDERED TH AT Plaintiffs' motion to amend the complaint and motion for summary judgment as to the breach of contract claims are DENIED. IT IS FURTHER ORDERED THAT the Johnstons shall file an answer to the Complaint with respect to the sole remaining cause of action - the breach of contract claim - no later than April 13, 2015. The case shall remain referred to Judge Ellis for general pre-trial supervision and for a report and recommendation on any dispositive motions, and the parties shall comply with any orders set forth by Judge Ellis. The Clerk of the Court is respectfully directed to terminate the motions pendingat docket entry numbers 4,10,18, and 22. SO ORDERED.
