Filing 42 MEMORANDUM AND ORDER granting in part and denying in part 34 Motion to Dismiss; granting in part and denying in part 30 Motion to Dismiss. For the reasons outlined above, defendant McCarthy's motion to dismiss the FDCPA claim is GRANTED. M cCarthy's motion for costs and fees pursuant 15 U.S.C. § 1692k(a)(3) is denied.
