MEMORANDUM AND ORDER granting in part and denying in part 34 Motion to Dismiss; granting in part and denying in part 30 Motion to Dismiss. For the reasons outlined above, defendant McCarthy's motion to dismiss the FDCPA claim is GRANTED. M cCarthy's motion for costs and fees pursuant 15 U.S.C. § 1692k(a)(3) is denied. The Court declines to exercise supplemental jurisdiction over the remaining state law claims and they are DISMISSED without prejudice. The Clerk is directed to close the case. (Signed by Judge P.
