OPINION & ORDER re: 25 CONCLUSION: The Court GRANTS Defendants' motion for partial summary judgment and dismisses the negligence cause of action (Claim 12). Trial is set for Monday, September 19, 2016. The final pretrial conference is Mo nday, September 12, 2016, at 3:30 pm in Courtroom 14C. Any motions in limine must be filed by Wednesday, September 7; any opposition must be filed by Friday, September 9.
