April 2, 2020 Opinion or Order Filing 152 ORDER granting 149 Motion of Final Distribution of Settlement Fund. IT IS HEREBY ORDERED THAT: 1. Plaintiffs' Motion is granted; 2. Distribution of the Net Settlement Fund will commence no later than five (5) business days after entry of this Order; 3. JND's determinations accepting the claims, as indicated in the exhibits to the Segura Dec., are approved, and said claims are hereby accepted; 4. JND's determinations rejecting the claims, as indicated in Exhibits D to the Segura Dec., are approved, and said claims are hereby rejected; 5. Any claims filed after January 31, 2020 are hereby barred; 6. No earlier than six (6) months from the date of this Order, any unclaimed, residual balance in the Net S ettlement Fund shall be redistributed to all Claimants who have cashed their checks from the first distribution and whose proportionate share of the remaining Net Settlement Fund is $10.00 or more;7. Thereafter, if any sums remain unclai med, and the unclaimed amount is not sufficiently large to warrant further distribution, the balance shall to be paid in equal amounts to the Institute for Law and Economic Policy; 8. JND will be paid outstanding fees and expenses in the amount of $777,974.93 and $54,968.10 in anticipated fees and expenses; 9. All persons involved in the review, verification, calculation, tabulation, or any other aspect of the processing of the claims submitted herein or otherwise involved in the administration or taxation of the Settlement Fund or the Net Settlement Fund are released and discharged from any and all claims arising out of such involvement, and all Class Members, whether or not they a re to receive payment from the Net Settlement Fund, are barred from making any further claim against the Net Settlement Fund or the released persons beyond the amount allocated to them pursuant to this Courts order; and 10. This Court shall retain jurisdiction over any further application or matter that may arise in connection with this Action. So Ordered.. (Signed by Judge Victor Marrero on 4/2/2020) (js)
February 2, 2016 Opinion or Order Filing 78 OPINION AND ORDER: For the foregoing reasons, plaintiffs' motion is GRANTED. The following Class is certified pursuant to Rule 23(a) and (b)(3): All purchasers of Barclays American Depositary Shares during the period from August 2, 2011 thr ough and including June 25, 2014, excluding Defendants, officers and directors of Barclays, members of their immediate families and their legal representatives, heirs, successors or assigns, and any entity in which Defendants have or had a controllin g interest. Lead Plaintiffs Mohit Sahni and Joseph Waggoner are appointed as Class Representatives, and Pomerantz LLP is appointed as Lead Counsel. April 24, 2015 Opinion or Order Filing 38 OPINION AND ORDER re: 28 MOTION to Dismiss Consolidated Amended Complaint. filed by Tushar Morzaria, Bob Diamond, Antony Jenkins, William White, Chris Lucas, Barclays Capital, Inc., Robert Diamond, Barclays PLC. For the forego ing reasons, defendants' motion is GRANTED solely to the extent that the section 20(a) claims are dismissed as to Individual Defendants Lucas and Morzaria, and is otherwise DENIED (except insofar as the alleged misstatements regarding Barclays&# 039; general business practices and risk controls and in response to the Salz report identified herein are deemed inactionable and plaintiffs may not seek damages based on the June 27 Telegraph article). Plaintiffs shall amend the Complaint within th irty days to comply with their obligations under Rule 11 as noted in section IV.A of this Opinion and Order. The Clerk of the Court is directed to close this motion (Docket No. 28). A conference is scheduled for May 5, 2015 at 4:30 p.m. SO ORDERED. (See Order.)
