Filing 43 OPINION AND ORDER re: 28 MOTION to Dismiss pursuant to Fed. R. Civ. P. 12(b)(6) filed by Rodolfo Bisono, Marcelo Razzo. For the reasons stated above, Defendants' motion to dismiss Plaintiff's Section 1983 claims is GRANTED. The Court dec lines to exercise supplemental jurisdiction over any state law claims and they are, therefore, dismissed without prejudice. The Clerk of the Court is respectfully directed to terminate the motion, Doc. 28, to mail a copy of this Opinion and Order to Plaintiff, and to close this case. Furthermore, the Court certifies, pursuant to 28 U.S.C. § 1915(a)(3), that any appeal from this Opinion and Order would not be taken in good faith; therefore, in forma pauperis status is denied for purposes of an appeal. See Coppedge v. United States, 369 U.S. 438,444-45 (1962). (As further set forth in this Order.) (Signed by Judge Edgardo Ramos on 1/26/2016) (adc) |
