Filing 25 OPINION AND ORDER re: 13 CROSS MOTION to Dismiss the petition filed by Ilan Preis. For the foregoing reasons, CGMI Petitioners' petition is GRANTED in part and DENIED in part, and Preis' cross-motion is GRANTED in part and DE NIED in part as follows: CGMI Petitioners' petition to enjoin the Sarbanes-Oxley Act claim from proceeding in the Second Arbitration is GRANTED, and Preis' cross-motion to dismiss and compel arbitration of these claims is DENIED. CGMI Pe titioners' petition to enjoin the Dodd-Frank Act, tortious interference, and prima facie tort claims is DENIED, and Preis cross-motion to compel arbitration of these claims is GRANTED. Preis' motion to dismiss the Dodd-Frank Act, tortiou s interference, and prima facie tort claims is DENIED, and these claims are STAYED in this action. CGMI Petitioners' petition that the Second Arbitration be heard before the same arbitration panel that presided over the First Arbitration is DENIED. The schedule for the remaining Sarbanes-Oxley claim will be addressed in a separate Order. The Clerk of Court is directed to close Docket Number 13. (Signed by Judge Lorna G.
