Ltd. For the foregoing reasons, Defendants' Motion to Dismiss the Amended Complaint is GRANTED IN PART and DENIED IN PART. Specifically, the claims against Isaiah Kingston and the five unknown Washakie entities for breach of contract are dismissed. The claim for breach of cont ract against Washakie survives. Plaintiff's Motion for Partial Summary Judgment is DENIED without prejudice to renewal. Washakie shall answer the operative complaint on or before July 20, 2015. The Motion to Dismiss the initial Complaint is DENI ED as moot. The Clerk of Court is directed to close the motions at Docket Numbers 13, 22, and 28. The caption also names Jacob Kingston and Rachel Kingston, who are alleged to be Washakie executives. As explained below, the claims against those parti es have been voluntarily dismissed by LifeTree. (As further set forth in this Order.) Rachel Kingston, Washakie Entity #1, Washakie Entity #2, Washakie Entity #3, Washakie Entity #4, Washakie Entity #5 (the last five names being entities currently unknown to plaintiff but believed to have entered into a contract with, and/or perpetrated a fraud against, plaintiff), Isaiah Kingston and Jacob Kingston terminated.
