Filing 70 OPINION & ORDER re: 58 MOTION for Partial Summary Judgment, filed by Julio Lebron. For the foregoing reasons, the Court grants Lebron's motion for partial summary judgment as to Hughes's false arrest claim. Hughes may p roceed to trial against Lebron on his excessive force claim. The Court directs counsel to meet and confer in person within three weeks of this decision to attempt to resolve this case. In the event a settlement is not reached, a joint pre trial order, motions in limine, proposed voir dire questions, and requests to charge will be due on October 31, 2016. Oppositions to any motions in limine will be due November 7, 2016. After the Court reviews the parties' submissions, the Court's staff will contact counsel to schedule a trial date. The Clerk of Court is respectfully directed to terminate the motion pending at Dkt. 58.
