The defendant, Blanca Torres Mutt, has moved to dismiss the Amended Complaint for failure to prosecut e pursuant to Federal Rule of Civil Procedure 41(b) or, in the alternative, as a sanction for failure to comply with this Court's Orders pursuant to Federal Rule of Civil Procedure 37(b)(2)(A). The plaintiff, Moises Ortega, proceeding pro se, ha s failed to respond to the motion. (As further set forth in this Order.) The Amended Complaint is dismissed without prejudice for failure to prosecute. The Clerk of the Court is directed to enter judgment and to close this case. ORDER OF SERVICE: With the exception of Blanca Torres Mutt, all defendants are dismissed from the action without prejudice. The Clerk of Court is directed to send to the plaintiff one USM-285 Form.
