May 8, 2017 Opinion or Order Filing 83 OPINION AND ORDER. Plaintiff Sefket Redzepagic ("Plaintiff) brought the above-captained action against Defendants claiming violations of the Fair Labor Standards Act (FLSA) for Defendants' failure to pay overtime wages. See Doc. 1. Plaintif f has submitted an application for the Court to approve the parties' Agreement and Release ("Agreement"). Doc. 82. The Court approves the Agreement for the reasons described in this Opinion and Order. The Court is satisfied with the bi lling rates that counsel assigned to each biller at Eisner & Dictor, P.C. and the number of hours spent for each task. Based on these sums, the Court finds that the requested attorneys' fees and costs of $25,919.18 are objectively reasonabl e. In terms of the non-monetary provisions, the Court finds all of them to be fair and reasonable. The Agreement, attached as Exhibit 1 to Doc. 82, is SO ORDERED. The Third Amended Complaint, Doc. 30, is dismissed with prejudice. The Clerk of the Court is respectfully directed to close the case. It is SO ORDERED. February 27, 2017 Opinion or Order Filing 79 OPINION AND ORDER re: 68 MOTION for Summary Judgment filed by 4750 Bedford L.L.C., L 4750, L.L.C., Melohn Properties Inc., A 4750, L.L.C., Leon Melohn, The Melohn Group L.L.C., Alfons Melohn. Defendants' motio n for summary judgment is GRANTED in part and DENIED in part. Defendants' motion for summary judgment as to the Individual Defendants Alfons and Leon Melohn is GRANTED. The Clerk of the Court is respectfully directed to dismiss Alfons and L eon Melohn as Defendants from this action. Defendants' motion for summary judgment as to Plaintiff's FLSA claims and Defendants' counterclaim for breach of contract is DENIED, and the Court dismisses Defendants' counterclaim fo r breach of contract as a matter of law. The Clerk of the Court is respectfully directed to terminate the motion, Doc. 68. The parties are directed to appear for a status conference on March 16, 2017 at 11:00 A.M.
