Filing 29 MEMORANDUM OPINION AND ORDER re: 19 MOTION for Summary Judgment Notice of Motion filed by T.W.-S., M.T., 24 MOTION for Summary Judgment filed by The New York City Department of Education. The Court empathizes with the Parents, and their desire for the best education possible for their child. But the law mandates a free appropriate public education; it does not promise an education of the Parents' choosing. In this case, the DOE met its burden of establis hing that it offered H.T. a FAPE for the 2010-2011 school year. For the reasons explained above, the DOE's motion for summary judgment is GRANTED and the Parents' motion for summary judgment is DENIED. The Clerk of Court is directed to close this case.
