MEMORANDUM OPINION AND ORDER re: 20 MOTION to Dismiss the Amended Complaint, filed by Andrew A. Cuomo, 29 JOINT MOTION to Dismiss the Amended Complaint or in the Alternative for Summary Judgment in Favor of Alan Gerst, Robert E . Michael and the Estate of Steven M. Elkman, filed by Stephen M. Elkman, Alan Gerst, Robert E. Michael. For the foregoing reasons, Defendants' motions to dismiss the Amended Complaint are granted. This Memorandum Opinion and Order resolves Docket Entry Numbers 20 and 29. The Clerk of Court is respectfully requested to enter judgment dismissing the case for lack of jurisdiction and close this case. The Court certifies, pursuant to 28 U.S.C. 1915(a)(3), that any appeal from this Memoran dum Opinion and Order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal.
