Filing 111 OPINION & ORDER re: 97 FIRST MOTION for Summary Judgment Notice of Motion, filed by Naralyn Ortega, Cernyak, Mitchell, Dentist C-73, Julissa Santos, Leman, 92 FIRST MOTION for Joinder of the City of New York in a Thir d-Party Action, filed by Hollinsworth. For the reasons set forth above, the Court hereby GRANTS the City's motion for summary judgment (ECF No. 97) and DENIES defendant Hollingsworth's motion for leave to implead the City (ECF No. 92) . In addition, plaintiff is ordered to show cause within fourteen days as to why his claims against defendant Hollingsworth should not be dismissed based on a failure to exhaust his administrative remedies.
