Filing 82 OPINION AND ORDER: Significantly, the issue for this Court is not whether it would have handled the arbitration proceedings in the same way as the Panel or reached the same result that the Panel reached. Instead, the issue is a more limited one: whe ther, in light of the substantial deference owed to an arbitrator in handling procedural matters and rendering a decision on the merits, Doscher has established any of the limited grounds for vacating or modifying the Award. For the reasons explained above, the Court concludes that he has not. Accordingly, his petition to vacate or modify the Award is DENIED, and the Award is confirmed. The Clerk of Court is directed to close the case. (Signed by Judge Jesse M. Furman on 12/6/2017) (mml) |
Filing 54 MEMORANDUM OPINION AND ORDER re: 31 AMENDED MOTION to Vacate Arbitration filed by Drew Doscher: For the reasons stated above, Doscher's petition to vacate the arbitration is dismissed for lack of subject-matter jurisdiction. The Clerk of the Court is directed to terminate Docket No. 31 and to close the case. (Signed by Judge Jesse M. Furman on 8/5/2015) (tn) |
