MEMORANDUMAND ORDER granting 42 Motion to Dismiss; granting 42 Motion for Judgment on the Pleadings; granting 45 Motion to Dismiss; denying 64 Motion to Intervene. For the above given reasons, defendants TWL's, Greenberg's, and Israel Discount Bank's motions to dismiss for failure to state a claim are granted and all plaintiff's claims are dismissed as to those three defendants. (Dkt. 42, 45) Because no claims against TWL and Greenberg survive the motion, TWL' ;s and Greenbergs claims for indemnity and contribution against the other defendants are also dismissed. In addition, Navana's motion for a default judgment against JDE is denied and all Navana's pending claims against JDE are dismissed. (Dkt. 55). The pending motion to intervene is also denied.
