Filing 40 OPINION AND ORDER re: 21 MOTION for Disclosure of FLSA Action filed by Elsito Saavedra, Zanatiel Flores, Camilo Martinez. For the reasons set forth above, Plaintiffs' motion for conditional certification and court-authorized n otice is DENIED without prejudice to its renewal upon a more developed factual record. See Feng, 2015 WL 1061973, at *4; see also Myers, 624 F.3d at 558 (noting that a district court "may continually evaluate, as the case progresses," wheth er notice of a pending FLSA action should be provided to potential opt-in plaintiffs). However, Defendants are hereby DIRECTED to produce to Plaintiffs, in Excel format, the aforementioned information regarding the Named Coworkers identified in Plaintiffs' Affidavits. The Clerk of Court is respectfully directed to terminate the motion, Doc. 21. It is SO ORDERED. (As further set forth in this Order.) (Signed by Judge Edgardo Ramos on 6/23/2016) (kko) |
