OPINION AND ORDER re: 17 CROSS MOTION for Summary Judgment, filed by New York City Department Of Education 13 MOTION for Summary Judgment, filed by I.B. The Parents' motion for summary judgment is granted, and the S RO's decision is reversed. The Parents' request for reimbursement for SEIT and related special education expenses from the DOE for the 12-month 2012-2013 year is granted. The DOE's motion for summary judgment dismissing the Complaint i s denied. The Parents' request for attorney's fees and costs is granted. The Parents are directed to file, within 30 days of this Opinion, a motion pursuant to Federal Rule of Civil Procedure 54(d)(2), accompanied by evidence identifying an d documenting the reasonable attorney's fees and costs they have incurred in connection with this action and the administrative proceedings below. Any opposition to the fee request must be filed within 14 days thereafter, and any reply papers mu st be filed within 7 days after the opposition papers are filed. The Clerk of Court is directed to enter judgment in favor of the Parents and close the case. This Opinion and Order resolves docket entry numbers 13 and 17. (As further set forth in this Order.)
