ORDER: Discovery shall commence and proceed in phases. The first phase shall be limited to and focused on the issues of corporate ownership and joint tortfeasor liability. The Plaintiffs have served document requests directed to these issues on each of the appearing Defendants pursuant to Rule 34, and all objections thereto have been resolved on December 9, 2015. Therefore, formal written responses to these requests together with responsive documents, and a privilege log setting forth each document withheld on a claim of privilege, will be provided to Plaintiffs' counsel no later than March 7, 2016. Plaintiffs' counsel shall have up to and including March 17, 2016 to review the produced documents. The parties will then appear before the Court for a status conference on March 28, 2016, to apprise the Court of their progress and to define the remainder of discovery on the corporate ownership and joint tortfeasor liability issues. The Defendants will also produce electronically stored information ("ESI") in accordance with agreed upon search terms. The ESI documents shall be produced in searchable formal, demarcating each document. To the extent that other production formats are requested or deemed necessary, the parties will seek to reach agreement. Defendants will also search for and produce copies of responsive documents in hard copy form for documents within the purview of the electronic search terms that are not available in ESI form. The parties shall meet and confer in effort to agree to terms of a protective order for the handling and treatment of confidential information in this action.
