Filing 16 MEMORANDUM OPINION AND ORDER: The Reeds now appeal from the October 6, 2014, Memorandum Opinion and Order Determining the Amount of Allowed Claim of Frank and Christina Reed (the "Final Order"), arguing that their allowed claim should have been higher. Because the Bankruptcy Court categorically excluded evidence that may support additional allowable damages under New Jersey law, I REVERSE the ruling limiting the scope of damages evidence permitted, AFFIRM the remainder of the Bankrup tcy Court's decisions, and REMAND for further proceedings consistent with this opinion. For the foregoing reasons, the decision of the Bankruptcy Court is affirmed in part, reversed in part, and remanded. The Clerk of Court is instructed to enter judgment accordingly and to close the case. (As further set forth in this Order.) (Signed by Judge Gregory H. Woods on 12/23/2015) (kko) |
