Filing 47 OPINION & ORDER re: 38 FIRST MOTION to Dismiss Amended Complaint, filed by The City of New York, 40 FIRST MOTION to Dismiss Amended Complaint, filed by The City of New York. For the foregoing reasons, Defendants 9; motion to dismiss for failure to state a claim is granted with prejudice with respect to Plaintiff's gender, race, religion, national origin, age, and disability discrimination claims as well as her retaliation, libel, and slander claim s. In addition, all claims against Defendants Fisher, French and Lynn are dismissed with prejudice. The unemployment discrimination claim under the New York City Human Rights Law against the remaining Defendants is dismissed without prejudice to it being refiled in a New York State court. The Clerk of Court is directed to terminate any pending motions, close this case, and mail a copy of this Opinion and Order to the pro se Plaintiff.
