Filing 100 OPINION & ORDER re: 70 MOTION to Dismiss Gibbs International, Inc.'s Counterclaim and Third-Party Complaint 54 . filed by Chandra Patel, Antarctica Star I, LP, Acre, LLC, Antarctica Star, LLC. This dispute arises out of a failed multi-billion dollar property transaction with the State of California. The crux of the dispute is whether Gibbs International, Inc. ("Gibbs") is entitled to, inter alia, some portion of a settlement related to this failed trans action. Ultimately, this Court finds the agreements unambiguous and not supportive of Gibbs's claims. (As further set forth in this Order.) For the reasons set forth above, Antarctica's motion to dismiss Gibbs's amended counterclaims and third-party complaint, converted to a motion for judgment on the pleadings, is GRANTED.
