OPINION AND ORDER re: 46 FIRST MOTION for Summary Judgment , filed by Zackary Dugow, 53 CROSS MOTION for Partial Summary Judgment on Breach of Fiduciary Duty (1st cause of action), filed by James Estrada. For the foregoing reasons, Defendant's motion for summary judgment is GRANTED in part and DENIED in part and Plaintiff's cross-motion for partial summary judgment is GRANTED as follows: Defendant's motion for summary judgment as to the breach of fiduci ary duty claim is DENIED. Defendant's motion for summary judgment as to the fraudulent misrepresentation claim is GRANTED. Plaintiff's cross-motion for partial summary judgment on the breach of fiduciary duty claim is GRANTED. The parties a re directed to appear for a status conference on Thursday, December 15, 2016 at 10:30 a.m. The Clerk of the Court is respectfully directed to terminate the motions, Docs. 46 and 53. OPINION AND ORDER re: 16 SECOND MOTION to Dismiss . filed by Redrush Entertainment LLC, Insticator, Inc., Zackary Dugow. For the reasons set forth above, the Court GRANTS Defendants' motion to dismiss with respect to Plaintiff s' claims for fraudulent conveyance and unjust enrichment, without prejudice, and DENIES Defendants' motion to dismiss with respect to Plaintiffs' claims for breach of fiduciary duty, fraudulent inducement, and declaratory relief. T he parties are directed to submit a joint proposed discovery schedule by April 19, 2016, on the form provided at nysd.uscourts.gov/judge/Ramos.
