MEMORANDUM OPINION AND ORDER: Thus, the Court grants Defendant's request for sanctions in the amount of $1,873.50, which shall be recoverable against only Mr. Viswanathan, and not Plaintiff himself, who is blameless for Mr. Viswanathan' ;s sanctionable conduct in this case. In light of Mr. Viswanathan's representation that he intends to go on sabbatical from his legal practice for some time, the Court declines to order him to attend continuing legal education courses at this ti me. If and when Mr. Viswanathan returns to his practice, however, he would be well advised to attend classes on litigation and/or trial practice and procedure and to take on only those cases that he can responsibly manage at once. OPINION AND ORDER re: 104 LETTER MOTION for Leave to File Withdrawal without prejudice of all Pending Claims against the Corporate Defendant, PDI addressed to Judge Ronnie Abrams from [GANESH] NADI VISWANATHAN, ESQ dated 12/21/201 6. filed by Saju George. For the reasons set forth above, George's motion to dismiss without prejudice is denied. Under Gravatt v. Columbia University, 845 F.2d 54 (2d Cir. 1988), "a district judge may convert a dismissal sought to be en tered without prejudice to one with prejudice" after providing the plaintiff an opportunity "to withdraw his motion and proceed with the litigation." Id. at 56; see also, e.g., Bosco v. United States, No. 14-CV-3525 (JFK), 2016 WL 53 76205, at *15 (S.D.N.Y. Sept. 26, 2016). The Court hereby gives George notice that, for the reasons discussed above, it intends to convert his motion to dismiss without prejudice into one with prejudice. George may withdraw his motion and proceed with this litigation. If George does not inform the Court that he intends to withdraw his motion by May 9, 2017, the Court will dismiss this action with prejudice. If George elects to withdraw his motion, his response to POi's motion for summ ary judgment shallbe filed no later than May 16, 2017.
