OPINION AND ORDER re: 43 MOTION to Withdraw Jury Demand and/or Motion to Compel Plaintiffs to Consent to Withdrawal, filed by UEC Concentric Merge Corporation, Uranium Energy Corporation. Defendants have moved to withdraw their d emand for a jury trial. Plaintiffs oppose this motion, arguing that the demand cannot be withdrawn without their consent. See Pls. Mem. at 7, 20-21. For the following reasons, defendants' motion is granted and the demand for a jury trial is deemed withdrawn. For the foregoing reasons, defendants' request to withdraw their jury demand and for the case to proceed as a bench trial (Docket #43) is granted, and as further set forth herein.
