October 24, 2017 Opinion or Order Filing 66 OPINION AND ORDER re: 65 SETTLEMENT AGREEMENT. Thus, because all of the other factors favor approval of the settlement (as explained in my October 18, 2017 Opinion & Order), I approve the settlement in this matter, as amended on September 25, 20 17 and October 20, 2017. In light of the settlement, the action is dismissed with prejudice and without costs. The Court shall retain jurisdiction to enforce the settlement agreement. See Hendrickson v. United States, 791 F.3d 354, 358 (2d Cir. 2015). The Clerk of the Court is respectfully requested to mark this matter closed. SO ORDERED. (Signed by Magistrate Judge Henry B. Pitman on 10/24/2017) Copies Transmitted By Chambers. (anc)
October 18, 2017 Opinion or Order Filing 64 OPINION AND ORDER re: 63 SETTLEMENT AGREEMENT. Given that the parties amended other portions of the settlement agreement to limit the general release, the failure to amend this language appears to be an oversight. Thus, because all of the other fa ctors favor approval of the settlement, I shall give the parties another opportunity to amend the settlement agreement for judicial approval. Accordingly, within 30 days of the date of this Order, the parties are to provide a revised settlement agreement that eliminates the foregoing issue. (Signed by Magistrate Judge Henry B. Pitman on 10/18/2017) Copies Transmitted By Chambers. (ras)
March 31, 2017 Opinion or Order Filing 62 OPINION AND ORDER: The parties reached their proposed settlement prior to the settlement conference that I had scheduled in this matter, and therefore, my knowledge of the underlying facts and the justification for the settlement is limited to counse ls' representations in the letters submitted in support of the settlement. (As further set forth in this Order.) Accordingly, within 30 days of the date of this Order, the parties are to provide the information sought and a revised settlement agreement that eliminates the foregoing issues. (Signed by Magistrate Judge Henry B. Pitman on 3/31/2017) Copies Sent By Chambers. (cf)
November 14, 2016 Opinion or Order Filing 60 OPINION AND ORDER: This matter is before me on the parties' joint application to approve the parties' settlement (Docket Items 54 & 55). (As further set forth in this Order.) Accordingly, the parties' application to approve the propose d settlement in this matter is denied without prejudice. Any renewed application should address the factors identified by Judge Furman in Wolinsky, the amount of damages claimed by each plaintiff and the basis therefore and an explanation for the allocation of the settlement amount. (Signed by Magistrate Judge Henry B. Pitman on 11/14/2016) Copies Sent By Chambers (cf)
April 20, 2016 Opinion or Order Filing 47 OPINION AND ORDER re: 17 MOTION to Certify Class filed by Zhong Qi Lin, Bao Cheng Fu, Guang Li Zhang: For the reasons set forth herein, Plaintiffs' motion for conditional certification of the FLSA collective action is D ENIED.
