STIPULATION AND SCHEDULING ORDER: The Parties have conducted a conference pursuant to Fed. R. Civ. P. 26(f) and will exchange initial disclosures pursuant to Fed. R. Civ. P. 26(a) on or before August 10, 2015. 2. The UMB Action will be subject to the outstanding dates for completion of discovery and the date for a final pre-trial conference pursuant to Fed. R. Civ. P. 16(d) set forth in paragraphs 4(c) through 4(g) of the June 2, 2015 Scheduling Order. 3. Discovery in the UMB Action shall be coordinated with discovery in the MeehanCombs, Danner, and BOKF Actions. No witness shall be deposed more than once in the actions. 4. Responses and objections to discovery requests served between the Parties shall be provided within 14 days of service. 5. UMB will not seek the production of documents from CBC beyond those that CBC has agreed or will agree to produce in response to requests from plaintiffs in the MeehanCombs, Danner, and BOKF Actions, except to the extent any such discovery is limited to facts unique to the UMB Action. 6. In light of UMB's agreement to abide by the existing Scheduling Order as set forth in paragraph 2 above, as well as the other agreements set forth in this Stipulation, the Parties agree, [and the Court orders] that the Initial Pretrial Conference in the UMB Action is adjourned without date. ORDER: Accordingly, I set the following schedule: BOKF had until today, June 19, to file its motion, CEC had three weeks to respond, and BOKF had two weeks to reply. On June 4, the Bankruptcy Court concluded hearings in the Adversary Proceeding, directed that post-trial briefs be filed by June 26, and stated that a ruling would be issued on or before July 22. On June 15, 2015, UMB commenced its action against CEC. The next day, it requested permission to file a motion for partial summary judgment on the same legal grounds asserted by BOKF, indicating it could do so one week after BOKF filed its motion. On June 17, CEC responded that while it maintains its prior objections, in the interests of judicial economy it, proposed the following schedule: both motions by June 26, 2015, responsive papers by July 24, and replies by August 7. On June 18, BOKF filed a letter "opposing any change... that would delay resolution of the legal issue involved in BOKF's motion." On consideration of the foregoing, the schedule proposed by CEC is acceptable to the Court. Both motions are due on June 26, 2015, responsive papers are due by July 24, and replies are due by August 7.
