Filing 91 MEMORANDUM OPINION AND ORDER: re: 27 MOTION for Summary Judgment filed by Otis Elevator Company, 26 FIRST MOTION for Summary Judgment filed by Otis Elevator Company. For the foregoing reasons, Defendant's motion for summary judgment is g ranted to the extent it seeks preclusion of Plaintiff's claims that are based on ordinary negligence principles and denied insofar as Plaintiff seeks to proceed on the basis of res ipsa loquitur. Defendant's motion pursuant to Federal Rule of Civil Procedure 37 to preclude the testimony of Plaintiff's expert witness is denied. Plaintiff's motion to strike Docket Entry Numbers 55-57 is denied as moot in light of the disposition of Defendant's summary judgment motion. The final pre-trial conference in this case is scheduled to proceed on February 23, 2018, at 11:30 a.m. The parties are directed to confer and file their joint pre-trial submissions in accordance with the Pre-Trial Scheduling Order (Docket Entry No. 13). The reference to Magistrate Judge Pitman for general pretrial management remains in effect. The parties are further directed to meet promptly with Magistrate Judge Pitman for settlement purposes.
