LLC, BMW of North America, LLC, Bayerische Motoren Werke Aktiengesellschaft. For the reasons set forth above, BMW's motion is GRANTED IN PART AND DENIED IN PART. All claims against BMW MC are hereby dismissed. The only surviving claim as to BMW NA and BMW AG is Catalanos N.Y. GBL § 349 claim. The Court will also allow Catalano an opportunity to replead solely his fraudulent concealment claim as to BMW NA and BMW AG. Catalano may file a second amended complaint for th at purpose not later than 14 days from the date of this Opinion & Order. The Clerk of Court is directed to close the motions at ECF Nos. 27 and 54.
