August 30, 2021 Opinion or Order Filing 156 ORDER OF DISCONTINUANCE: Accordingly, it is hereby: ORDERED that this action be conditionally discontinued without prejudice and without costs; provided, however, that within thirty (30) days of the date of this Order, the parties may submit t o the Court their own Stipulation of Settlement and Dismissal for the Court to So Order. Otherwise, within such time Plaintiff may apply by letter for restoration of the action to the active calendar of this Court in the event that the settlement is not consummated. Upon such application for reinstatement, the parties shall continue to be subject to the Court's jurisdiction, the Court shall promptly reinstate the action to its active docket, and the parties shall be directed to appear before the Court, without the necessity of additional process, on a date within ten (10) days of the application, to schedule remaining pretrial proceedings and/or dispositive motions, as appropriate. This Order shall be deemed a final discontinu ance of the action with prejudice in the event that Plaintiff has not requested restoration of the case to the active calendar within such 30-day period. June 2, 2021 Opinion or Order Filing 142 ORDER: The Clerk's Office has now notified the Court that this case has been placed on the jury trial list for September 15, 2021. The case must be trial-ready for that date. The case is first on the list for jury trials for that day. This m eans that the Clerk's Office has scheduled two back-up cases for the September 15, 2021 trial date. If the case cannot proceed on the scheduled date, the parties must notify the Court as soon as possible so that the Clerk's Office may alloc ate that trial date to one of the back-up cases. The Court has previously entered a schedule for pretrial submissions. (See Dkt. #141).
