October 2, 2019 Opinion or Order Filing 141 MEMORANDUM OPINION AND ORDER for 140 Report and Recommendations. Magistrate Judge Aaron issued a Report and Recommendation dated September 6, 2019 that recommended that no damages be imposed but that D'Addio be ordered to remove two false and defamatory blog posts. Dkt. No. 140. No objections have been filed and the time for objections has passed. In any event, the Court finds that the Report and Recommendation are generally well reasoned and should be adopted. Therefore, the Court directs the Clerk to issue a final judgment dismissing all of the plaintiff's claims in this action with prejudice, and granting a judgment in this action to the defendant, Kerik, against the plaintiff, D'Addio, on the defendant's coun terclaims. The plaintiff is directed to remove the blog posts dated April 15, 2015, and October 10, 2015 described in paragraphs 24(i) and 24(k) of the counterclaims. No damages or costs are to be awarded in this action. Because all of the claims in this action as to all of the parties have been resolved, the Clerk is directed to close this action and to close any pending motions. (As further set forth in this Order.) (Signed by Judge John G. Koeltl on 10/1/2019) (cf) Transmission to Orders and Judgments Clerk for processing.
May 14, 2019 Opinion or Order Filing 137 ORDER for 124 Motion for Default Judgment, Motion to Dismiss/Lack of Prosecution, Motion for Sanctions, Motion for Attorney Fees, filed by Bernard B Kerik, 136 Report and Recommendations. The Court finds that the Report and Recommendation is well reasoned and should be adopted. The Court dismisses the Amended Complaint with prejudice and enters a default judgment against the plaintiff, Dara L. Daddio, on the defendant's counterclaims against her. The case is remanded to the Magistrate Judge for an inquest on damages, and any other appropriate relief. The Clerk is directed to close Docket Number 124. SO ORDERED. (Signed by Judge John G. Koeltl on 5/14/19) (yv)
July 12, 2017 Opinion or Order Filing 97 ORDER for 77 Motion for Writ, filed by Donna M D'Addio, Dara L DAddio, 95 Report and Recommendations. The Court finds that the Report and Recommendation is well reasoned and correct. The Court therefore adopts the Report and Recommendatio n. The motion by the plaintiff's former attorney Autondria S. Minor for a retaining lien on behalf of her law firm, Schmeiser, Olsen & Watts LC, in the amount of $43,894.29 is granted. The Clerk is directed to close ECF No. 77. SO ORDERED. (Signed by Judge John G. Koeltl on 7/11/17) (yv)
