Filing 52 REDACTED MEMORANDUM OPINION AND ORDER re: 34 MOTION for Summary Judgment . filed by Vincent Miccoli, Sukuslich, Morticor. For the foregoing reasons, the Individual Defendants' motion for summary judgment is granted, and the Court dismisses the Complaint as against the City Defendants sua sponte. This Memorandum Opinion and Order resolves docket entry number 34. The Court certifies, pursuant to 28 U.S.C. § 1915(a)(3), that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal. See Coppedge v. United States, 369 U.S. 438, 444-45 (1962). The Clerk of Court is respectfully requested to enter judgment in favor of Defendants, and close this case.
